Welcome to TokPilot. By using our services, you agree to these Terms of Service. Please read them carefully.

1. Acceptance of Terms

By accessing or using TokPilot ("Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, do not use the Service.

2. Description of Service

TokPilot is a content creation and publishing platform that:

  • Generates images using AI (Google Gemini)
  • Generates videos using AI (Kling AI)
  • Publishes content to TikTok via the Late.dev API
  • Allows users to manage content as drafts or published posts

3. User Accounts & Authorization

To use the publishing features, you must connect your TikTok account through our third-party partner Late.dev. By connecting your account, you:

  • Authorize TokPilot to post content to your TikTok account on your behalf
  • Confirm you have the right to connect and use the account
  • Agree to comply with TikTok's Terms of Service and Community Guidelines

4. Acceptable Use

You agree NOT to use TokPilot to:

  • Create or distribute harmful, illegal, or misleading content
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Spam, harass, or deceive other users
  • Attempt to circumvent platform restrictions or policies
  • Create content that violates TikTok's Community Guidelines

5. User Content & Rights

You retain ownership of content you upload to TokPilot. By using our Service, you grant us a limited license to process, transform, and publish your content as directed by you.

You represent that you have all necessary rights to the content you upload and that your content does not infringe on the rights of any third party.

6. AI-Generated Content

TokPilot uses artificial intelligence to generate images and videos. You acknowledge that:

  • AI-generated content may require disclosure on platforms like TikTok
  • TokPilot provides an AI disclosure toggle for compliance
  • You are responsible for ensuring AI-generated content meets platform requirements
  • AI outputs may not always match expectations and are provided "as is"

7. Platform Compliance

TokPilot enforces TikTok's content requirements including:

  • Video posts require exactly one video file
  • Photo carousels support 1-35 images
  • Privacy and interaction settings (comments, duets, stitches)
  • Express consent and content preview confirmation before publishing

8. Draft vs. Publish Mode

TokPilot offers two publishing modes:

  • Draft Mode: Content is sent to your TikTok Drafts for review before posting
  • Publish Mode: Content is posted directly to your TikTok account

We recommend using Draft Mode to review content before it goes live.

9. Limitation of Liability

TokPilot is provided "as is" without warranties of any kind. We are not liable for:

  • Content generated by AI systems
  • Actions taken by TikTok or other platforms on your content
  • Loss of data or content
  • Indirect, incidental, or consequential damages
  • Service interruptions or errors

10. Termination

We may suspend or terminate your access to TokPilot at any time for violation of these terms or for any other reason. You may stop using the Service at any time.

11. Changes to Terms

We may update these Terms from time to time. We will notify you of significant changes by updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the new terms.
